Terms of Service

These terms govern your use of MapsData (mapsdata.ai), a product of Hiive Arts ("we", "us"). By creating an account or using the service you agree to them. Questions: admin@mapsdata.ai.

The service

MapsData generates business lead lists from publicly available sources, including Google Maps listings and public business websites. Results depend on what is publicly available at the time a search runs.

MapsData is an independent product. It is not affiliated with, endorsed by, or sponsored by Google. Google Maps is a trademark of Google LLC.

Your account

• Provide accurate information and keep access to your sign-in email or Google account secure. You are responsible for activity under your account.
• Free trials are limited to one per organization, with the limits shown at signup.
• Team members you invite are covered by these same terms.

Plans and billing

• Paid plans are monthly subscriptions billed through Stripe. Each plan includes a monthly allowance of leads, counted as delivered leads with email addresses, metered when a search completes. The allowance resets with your billing cycle.
• A search that is already running when you reach your allowance is allowed to finish, and leads it delivers beyond the allowance are included at no extra charge. Starting new searches requires available allowance.
• You can change or cancel your plan at any time from the billing page; cancellation takes effect at the end of the current billing period.
• Leads already delivered are non-refundable. If something goes wrong on our side, such as a failed or unusable delivery, contact us within 30 days and we will credit or refund the affected usage.
• If we change plan prices, existing subscriptions keep their price until we give at least 30 days' notice, and changes take effect from a later billing cycle.

Acceptable use

• Use lead data lawfully. If you contact leads, you are responsible for complying with the marketing and privacy laws that apply to you and your recipients (for example CAN-SPAM, CASL, GDPR and PECR), including honoring opt-outs.
• Do not use the service for anything unlawful, deceptive, or harmful.
• Do not attempt to disrupt the service, circumvent usage limits, or resell raw access to the service itself.

Your data

The lead lists you generate are yours to use for your business. Because they are compiled from public sources, they are not exclusive: the same public business information may appear in other customers' lists. We cache compiled business data to operate the service efficiently. Our handling of personal data is described in the Privacy Policy.

Disclaimers

Lead data is compiled from public sources and is provided as is. We do not guarantee the accuracy, completeness, or deliverability of any individual record, and we do not guarantee uninterrupted availability of the service, though we work hard on both.

Liability and indemnity

To the maximum extent permitted by law, our total liability for any claim arising out of the service is limited to the amount you paid us in the three months before the claim arose. We are not liable for indirect or consequential damages.

You agree to indemnify us against claims brought by third parties that arise from your use of lead data, your outreach or other communications to leads, or your breach of these terms.

Termination

You may stop using the service at any time. We may suspend or terminate accounts that violate these terms, with notice where reasonable.

Changes

We may update these terms as the service evolves. We will update this page and the date above, and notify account holders by email of significant changes. Continued use after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of Canada, where Hiive Arts is registered, without regard to conflict-of-law rules.
